Before joining the staff of Fabian & Associates Inc, P.C., Mr. O'Brien was an attorney with the Oklahoma Department of Public Safety's ("DPS") Legal Division for more than seven (7) years. During this time, he prosecuted, and/or, sat as an Administrative Hearing Officer (or Judge) in several THOUSAND driver's license cases related to alcohol related arrests. Mr. O'Brien has taken over two (2) dozen DUI/driver's license cases to the Oklahoma Supreme Court and had over one (1) dozen of these published, establishing new law on each. As examples, he is responsible for the status of the law as it exists today on roadblocks and secondary breath tests in the State of Oklahoma. Additionally, he has even written proposed legislation relating to DUI and driver's license statutes.

Mr. O'Brien has been certified by the Oklahoma Board of Tests as a Breathalyzer Operator, as well as, a Breathalyzer Maintenance Supervisor. He has taught training courses for the State of Oklahoma to Police Officers on the operation of both the Breathalyzer AND Intoxilyzer 5000.

Prior to becoming an attorney, Mr. O'Brien was a Police Officer for the Oklahoma City Police Department for five (5) years. During this period, he made over 500 arrests for DUI. He has administered several HUNDRED breath tests to persons of all ages.
